What we collect when you use this site, why we collect it, who it is shared with, and the control you have over it. Written to describe what this site actually does — not a template.
01Who we are and what this policy covers
Next Level Software LLC (“Next Level Software”, “we”, “us”) is a custom software development company with a registered office at 605 W 9th Street Unit #1057, Austin, TX, USA, and a delivery centre in Faisalabad, Pakistan. We are the data controller for the personal information described here.
This policy explains what we collect when you visit thenextlevelsoftware.com, enquire about our services, apply for a role, or use the AI assistant — and what we do with it.
It does not cover data we process on behalf of a client inside software we have built for them. In that situation the client is the controller and their own privacy policy applies; we act as a processor under the agreement with them.
02Information we collect
Information you give us. Only what the form in front of you asks for:
- Project enquiries — your name, email address, phone number, the service you are interested in, and your message.
- Job applications — your full name, email address, phone number, city, education, the role you are applying for, years of experience, current company, LinkedIn profile, and your cover letter.
- AI assistant — the messages you type into the chat widget.
- Direct contact — anything you choose to include when you email, call, or message us on WhatsApp or a social platform.
Information collected automatically. Like most websites, our analytics records technical and usage data: IP address (from which an approximate location is derived), device and browser type, operating system, the pages you view and how long you spend on them, the page or search that referred you, and the links you click.
We do not ask for and do not want special category data — health, biometric, racial or ethnic origin, political, religious, or trade union information — and we ask that you do not send it to us. We do not collect payment card details through this website; invoices for client work are handled through separate billing and payment platforms.
03How we use your information, and our legal basis
We use personal information only for these purposes:
- To answer your enquiry and prepare a scope, estimate, or proposal — because you asked us to, as a step towards entering a contract.
- To deliver and support projects we have been engaged for — performance of our contract with you.
- To assess job applications and communicate with candidates — because you asked us to, and our legitimate interest in recruiting.
- To operate, secure and improve the Site, including analytics, rate-limiting the AI assistant, and preventing abuse — our legitimate interest in running a functioning, secure website.
- To send updates or marketing — only where you have asked for them, or where you are an existing client and the message relates to similar services. You can opt out at any time.
- To comply with legal, tax and accounting obligations, and to establish or defend legal claims.
We do not sell or rent your personal information, and we do not share it for cross-context behavioural advertising. We do not use your data to make decisions about you by automated means alone.
04The AI assistant
The chat widget on this Site sends your messages to our server, which forwards the recent part of the conversation to a third-party AI provider so a reply can be generated, and streams the answer back to you. We do not use your chat messages to train AI models, and our provider is engaged under terms that prohibit training on data sent through our account.
Your transcript is stored in your browser’s session storage so the conversation survives a page change. Closing the tab clears it. We may retain server-side logs of conversations for a limited period to monitor quality, abuse, and errors.
Please do not enter passwords, payment details, or confidential or personal information about other people into the chat. If you want to share project details privately, email us instead.
07International transfers
We operate from the United States and Pakistan, and our providers may process data in the United States and other countries. If you are in the UK, EEA, or another region with data transfer restrictions, this means your information may be transferred outside it. Where that happens we rely on appropriate safeguards — such as the European Commission’s Standard Contractual Clauses — and contractual confidentiality and security commitments with everyone who handles the data.
08How long we keep it
We keep personal information only as long as it is useful for the purpose it was collected for:
- Enquiries that do not become projects — up to 24 months, so we can pick up the conversation if you come back.
- Client records — for the life of the engagement and afterwards for as long as tax, accounting, and legal-claim periods require.
- Job applications — up to 12 months, so we can contact you about future roles, unless you ask us to delete them sooner.
- Analytics data — retained according to our Google Analytics configuration, then deleted or aggregated.
When we no longer need it, we delete it or irreversibly anonymise it.
09How we protect it
The Site is served over HTTPS, API keys are held server-side and never exposed to the browser, access to our inbox and business systems is restricted to the people who need it and protected by multi-factor authentication, and our team is bound by confidentiality obligations. No system is perfectly secure, so we cannot guarantee absolute security — but if a breach affects your personal information, we will notify you and the relevant regulator where the law requires it.
10Your rights
Depending on where you live, you may have the right to: access the personal information we hold about you; correct it if it is wrong; ask us to delete it; object to or restrict how we use it; receive it in a portable format; and withdraw consent at any time where we relied on it. You can unsubscribe from marketing at any time using the link in the message or by emailing us.
If you are in California, you also have the right to know what we collect and why, to request deletion or correction, and not to be discriminated against for exercising those rights. We do not sell or share personal information as those terms are defined under the CCPA/CPRA.
To exercise any right, email info@thenextlevelsoftware.com with what you would like us to do. We may ask for information to confirm your identity, and we will respond within the time the applicable law allows — normally within one month. If you are in the UK or EEA and are unhappy with our response, you may complain to your local supervisory authority.
11Children’s privacy
The Site is aimed at businesses and is not directed at children. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us their information, contact us at info@thenextlevelsoftware.com and we will delete it.
12Third-party links and social features
Our pages link to profiles and services we do not control — Clutch, Upwork, LinkedIn, YouTube, Instagram, X, Facebook, TikTok, WhatsApp, and others. Following a link, or using a social sharing feature, means that provider may collect information about you under its own privacy policy. We are not responsible for their practices, so please read their policies before sharing anything with them.
13Changes to this policy
We update this policy when our practices, services, or legal obligations change. The current version always lives at this URL and the “last updated” date at the top of the page tells you when it last changed. Where a change materially affects how we use information you have already given us, we will tell you directly rather than relying on this page alone.
